Agencies rescind SPCP statement

Federal banking regulators rescinded the Interagency Statement on Special Purpose Credit Programs Under the Equal Credit Opportunity Act and Regulation B, dated Feb. 22, 2022.
Details: The agencies said they are rescinding the statement to make it clear that creditors may not discriminate against borrowers based on prohibited characteristics.
ICBA View: In a December 2025 letter to the Consumer Financial Protection Bureau, ICBA said it opposes changes to SPCP eligibility because prohibiting the use of race or sex as a criteria for eligibility would make SPCPs a less effective tool for increasing credit access in underserved areas and would make them less useful to banks that use them to comply with fair lending laws and the Community Reinvestment Act.
