The Consumer Financial Protection Bureau issued an interpretive rule clarifying that the prohibition against sex discrimination under the Equal Credit Opportunity Act and Regulation B includes discrimination related to sexual orientation and gender identity.
More: The agency said this prohibition also covers discrimination based on actual or perceived nonconformity with traditional sex- or gender-based stereotypes and on an applicant’s social or other associations.
Background: The CFPB said its interpretive rule is consistent with the Supreme Court’s decision in Bostock v. Clayton County, Ga., which applies the Civil Rights Act's prohibition against sex discrimination to sexual orientation and gender identity.
